1. Definitions and Acceptance of Terms

For the purposes of these Terms and Conditions, the term "Client" includes, but is not limited to:

  • Individual consumers and customers;
  • Patients;
  • Retail customers;
  • Wholesalers;
  • Distributors;
  • Resellers;
  • Retail stores;
  • Pharmacies;
  • Online customers:
  • Healthcare practitioners;
  • Online retailers;
  • E-commerce platforms;
  • Agents;
  • Any other individual or organisation purchasing, receiving, distributing, marketing, reselling or using products supplied by Suplify Health (Pty) Ltd.

 

By requesting a quotation, placing an order, purchasing, receiving, distributing, reselling or using any product supplied by Suplify Health (Pty) Ltd ("Suplify Health", "we", "our" or "us"), the Client confirms that they have read, understood and accepted these Terms and Conditions.


2. Product Information

Suplify Health manufactures, packages and supplies vitamins, nutritional supplements and related health products.

Our products are intended to support general health and wellness and are not intended to diagnose, treat, cure or prevent any disease unless specifically stated and permitted by applicable South African legislation.

 

Product information, descriptions, labels and marketing material are provided in good faith and are believed to be accurate at the time of publication.


3. Medical Disclaimer

The information provided by Suplify Health, whether on product labels, packaging, brochures, websites, social media or any other communication, is provided for general informational purposes only and does not constitute medical advice.

Clients are solely responsible for determining whether any product is suitable for their own circumstances or those of their customers.

 

If you are:

  • Pregnant or breastfeeding;
  • Taking prescription medication;
  • Suffering from any medical condition;
  • Under medical supervision;
  • Have known allergies or sensitivities; or
  • Are unsure whether a product is suitable,

you should consult your physician, pharmacist or other qualified healthcare professional before using any Suplify Health product.


4. Client Responsibilities

The Client agrees and accepts responsibility to:

  • Read all labels and instructions before use.
  • Understand the ingredients and intended purpose of each product.
  • Use products only as directed.
  • Follow all dosage recommendations.
  • Keep products out of reach of children.
  • Discontinue use immediately should any adverse reaction occur and seek appropriate medical advice.

Retailers, wholesalers, distributors, online stores and resellers are responsible for ensuring that products are sold in their original condition and that all product information supplied by Suplify Health accompanies the products where reasonably applicable.


5. Limitation of Liability

To the maximum extent permitted by the laws of the Republic of South Africa, Suplify Health shall not be liable for any direct, indirect, incidental, consequential or special damages, losses, illness, injury, allergic reaction or claims arising from or related to:

  • Use or misuse of any product;
  • Failure to follow product instructions;
  • Excessive consumption;
  • Incorrect dosage;
  • Allergic reactions;
  • Drug interactions;
  • Existing medical conditions;
  • Failure to obtain medical advice;
  • Use of products contrary to medical advice;
  • Improper storage or handling;
  • Any use of the products after they have left the control of Suplify Health.

 

Individual responses to vitamins and nutritional supplements vary from person to person and no guarantee is made regarding specific health outcomes.

Nothing contained in these Terms excludes any rights that cannot legally be excluded under applicable South African law.


6. Storage

Unless otherwise indicated on the product label, all products must be stored:

  • In a cool, dry place;
  • Away from direct sunlight;
  • Away from excessive heat and humidity;
  • In their original sealed packaging.

Products should not be refrigerated unless specifically instructed on the product packaging.

Improper storage may reduce product quality, effectiveness and shelf life.


7. Delivery, Ownership and Risk

All products are inspected before leaving the Suplify Health premises.

Risk in the products passes to the Client immediately upon collection by the Client, or handover to a courier, transporter or logistics provider.

 

Suplify Health shall not be responsible for:

  • Damage during transportation;
  • Incorrect storage after delivery;
  • Contamination;
  • Product deterioration;
  • Incorrect handling;
  • Improper display;
  • Repackaging;
  • Relabelling;
  • Tampering;
  • Loss or theft;
  • Damage caused by third parties.

 

Where products are supplied to wholesalers, distributors, retailers, pharmacies, online stores or resellers for onward sale, such parties accept full responsibility for the storage, transportation, handling, display, marketing and resale of the products after collection or delivery.

Suplify Health shall not be liable for any damages, losses or claims arising after the products have left our premises or control.


8. Product Quality

Suplify Health is committed to maintaining high standards of manufacturing and quality assurance.

Clients acknowledge that vitamins and nutritional supplements are nutritional products and that individual results may vary.

No guarantee or warranty is made that any particular result or health benefit will be achieved.


9. Returns

Returns and exchanges will be considered in accordance with applicable South African consumer protection legislation.

Products that have been:

  • Opened;
  • Used;
  • Tampered with;
  • Repackaged;
  • Incorrectly stored; or
  • Damaged after delivery,

may not qualify for return unless otherwise required by law.

 

Customers returning products should return the product to Sulify Health at their own cost and document exactly what the issue is and the reason for return.

 

Suplify Health will determine whether we will replace the product or not or refund the customer if we believe it is necessary. This will be determined at our own discretion. Under GMP / SAHPRA guidelines and according to SA Law.

 

Products stored, transported or used incorrectly will not be refunded.


10. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any dispute arising from these Terms and Conditions shall be subject to the jurisdiction of the competent courts of South Africa.


11. Severability

Should any provision of these Terms and Conditions be found to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.


12. Amendments

Suplify Health reserves the right to amend these Terms and Conditions from time to time without prior notice. The latest published version shall apply to all future transactions unless otherwise agreed in writing.
